On the first day of NBA free agency the Houston Rockets and Nene agreed to a four-year contract that extension that, as it turns out, violated the NBA’s Over 38 rule.

What exactly is the over 38 rule? It’s a bit complicated, but it’s designed to remove the incentive for older players signing long contracts that would carry them into their retirement. For any player that would be over 38 at the conclusion of their contract, the seasons past 38 are considered to be in their retirement and the money must be shifted into previous years.

Nene would have been 38 entering the final year of that contract extension. Stunningly, the Rockets made a misstep and offered Nene what amounted to an illegal contract. It didn’t prove to be much of a roadblock, though.

Nene wanted to stay in Houston, Rockets GM Daryl Morey wanted to keep Nene in Houston, and early on Sunday afternoon the two sides agreed to a three-year $11 million contract that will keep Nene in Houston.

Fit

The Rockets were keen on bringing back Nene to solidify their frontcourt bench, where last season he averaged 9 points and just over 4 boards. He is expected to once again be the main big off the bench for the Rockets while Clint Capela gets a breather.

Nene was a huge playoff factor for the Rockets, scoring 28 points and grabbing 10 rebounds on 12–12 from the field in a key Game 4 over Oklahoma City. Nene was injured in the second round series against the San Antonio Spurs, missing the final two losses of the Rockets season. His veteran experience might not have made up all of the difference, but it definitely hurt the Rockets not having him.

On both ends of the floor, Nene brings toughness, physicality and skill. He’s a canny passer and a strong inside scorer, and even though he’s getting older he still has the incredible strength that’s distinguished him throughout his career. In that respect, he’s a good contrast to Clint Capela, who’s still growing into his frame.

One of the main reasons Nene hasn’t made more money over the last couple of years or played more minutes is because of health. Most seasons over the last several years he’s missed about 20 games per year, while being limited in other games. In Houston he was the best version of himself, staying healthy and productive for much of the year. They’re hoping he can continue that trend.

With the continued depth the Rockets add, getting Nene on this cheap of a deal will keep cap space a bit more open for Morey to negotiate around and continue to add more pieces and assets in their chase of the Golden State Warriors.
