Beach weather is putting a controversial subject in the spotlight in Ocean City, Maryland.

That subject is topless sunbathing.

A woman’s advocate asked the State Supreme Court to clarify Maryland’s law on the matter — but that has taken several months.

Parents say topless bathing isn’t family-friendly, but police are adopting a wait-and-see attitude.

“It’s really based on the particular situation and how it’s presented,” say police.

“The beach is something we are trying to incorporate as a family. It would turn us away and we would go elsewhere,” said a father.

Maryland is one of several states with ambiguous laws on toplessness.

Several cities across the country have laws allowing a choice between tops or no tops.

Women who sunbathe topless at a Maryland resort town used to get a scolding from beach patrol officers, but that has changed.

The head of the Ocean City Beach Patrol said Jun 8, 2017 in a memo that workers should document complaints of toplessness.

But, they should not approach topless women — even if beach-goers request it.

Chelsea Covington, an advocate for normalizing toplessness, asked Worcester County’s state’s attorney last year to examine the law. He, in turn, asked Maryland’s attorney-general for an opinion. Officials haven’t heard back.

For years, the beach patrol would just tell topless women “Hey, you can’t do that.”

But, without an opinion from the attorney-general, he says they don’t feel like they can tell women not to sunbathe topless.
