ALFA Applauds Nevada For Passing Consumer Legal Funding Legislation

Washington, D.C., June 6, 2019 — This week, Democratic Nevada Governor Steve Sisolak signed into law S.B. 432, which would regulate consumer legal funding in the state. By defining key terms relevant to consumer legal funding and setting strict requirements for licensure and non-interference, the bills will benefit victims seeking justice through the courts.

“The American Legal Finance Association applauds Governor Sisolak and the Democrat-led Nevada legislature for enacting this law,” said Kelly Gilroy, Executive Director of ALFA. “ALFA has long advocated for strong regulation and oversight of consumer legal funding. We hold our members to the highest ethical standards through the ALFA Code of Conduct, and this legislation formally institutes many of them in Nevada. We encourage lawmakers in other states to adopt strong consumer legal funding regulations, as well.”

Too often, victims who have been harmed and have filed a lawsuit are forced to accept unfair settlements or fold their cases because they are unable to pay for everyday needs like rent, food, or medical bills during the pendency of their case. These regulations will promote best practices in legal funding while ensuring consumers who are seeking justice through the legal system retain access to a vital resource. ALFA has supported similar legislation in Oklahoma, Vermont, Indiana, and Tennessee to enact consumer legal funding regulations that protect victims and help maintain equal access to justice for all.
