How is the Apache Foundation in opposition with Software Patents?

The logic seems pretty good to me. If you loose React, any IP dispute means you loose the rights to use it. If it were Apache 2.0 licensed, that would happen only if you sue Facebook for using React.

It goes against open source, that any software you use automatically removes or limits some of your rights, in this case the right to protect your IP against Facebook.

Am I missing something? How is this opposed to software patents?
