THE JUSTICE SYSTEM IN THE US ARMY NEEDS TO BE REFORMED

TO: UNITED STATES SECRETARY OF THE ARMY-Mark Esper, June 2019

Reference: The US Military Justice System is in urgent need of reform

Dear Secretary of the Army Mark Esper

I am requesting your assistance in having CID to investigate my discharge from the Department of The Army.

The US military justice system is in ‘urgent need of reform. The US Army (military) fails to hold its officers (soldiers) accountable for unlawful abuse upon US service members; of which equates to TOXIC LEADERSHIP. I am accusing the United States military justice system and the Department of the Army and Defense Inspector General’s office of rarely conducting formal criminal investigations of toxic leadership and the fact it leads to suicides, illegal discharges, wrongful imprisonment, rape, and false mental health reports.

The Department of the Army has seemed to carry out internal wars crimes against members of the army. Without, notice from you and members of congress. Victims, family members and eyewitnesses to behavior of toxic leaders in the US Army have been intimidated not to tell the true accounts of the abuse of soldiers. Of, which leads to the destruction of soldiers lives and future.

A review of the US Army investigative practices has fallen short of what is needed to ensure accountability for alleged crimes and abuse of authority against soldiers. A focus in particular, on the failure of the US military justice systems (as well as IG, SJA’s and post Commanders); to conduct serious investigations of toxic members in commands; has played a significant role of the destruction of military members lives.

Incidents, such as the court martial of myself, (US v. Pitt) has allowed the true perpetrators to go free and (not properly investigated due to their rank), under investigated and unpunished. The inability of lower enlisted members to access justice after experiencing incidents from toxic leaders results in wrongful discharges and false mental health referrals and reports as forms of intimidation (it’s the new don’t ask don’t tell). In fact officers are immune from prosecution when lower rank enlistees are making the complaint. General, Colonels, Majors Etc………..

In the vast majority of cases of true reports of abuse from enlisted members of the army; even where the available evidence suggests that abuse and toxic leadership were unlawful. Many soldiers have, in their desperation resorted to suicide, going AWOL and or trying to defend their selves only to end up with no future in the army or in the civilian world.

I was one of those soldiers. I was court martial, reduced in rank, and thrown in the Navy Brig for a 90 day sentence. I am now unable to continue my education into law. I make a little above minimum wage and live pay check to barley making it to the next pay check.

I stood up to US Army toxic leaders after a year of bullying, reprisals, retribution, rumors, being denied medical care, ridiculing, humiliation, interference of my MOS, and the last straw was a false mental health referral that lead to being forced to take and out dated mental health instrument. The toxic leaders in my command dehumanized me for filing a complaint- HIPPA violation.

It is extremely rare that cases involving officers reach the prosecution stage — but even if they do, there are huge structural problems with the military court system.

There are disproportionate amount of enlistees being jailed for non-criminal offenses (such myself). Not only is it an injustice; it is overkill. There is compelling evidence that I was being mistreated by the command and that members of the battalion, brigade and post commander were aware of the abuse. It was ignored because the abusers were officers. They were friends, buddies protecting each other and I was nothing; not even human or an American to them.

Essentially a form of self-policing, the US military justice system relies on soldiers or commanders themselves to report possible human rights violations to trigger an investigation — but there are few incentives for them to do so. On those rare occasions when cases do make it to the prosecution stage, there are still serious concerns about the independence and transparency of the military courts, post commanders; SJA’s etc… — and the victims are rarely called upon to testify (as in my case).

That is exactly the problem — US Army officers are immune from prosecution therefore IG ignore reports and or do not properly report cases of toxic commands(instead the enlistees are blamed; due to false counseling’s, false testimonies and intimidation and more).

This means that enlistees; themselves who may have suffered human rights abuses have no way of actually filing criminal complaints against US Army officers.

Mark Esper. I am urging you and congress to stop military toxic leaders to ensure that accountability for unlawful treatment of soldiers are taken seriously. And, that US Army soldiers are guaranteed fair, unbiased treatment and safety. Scrutiny of soldiers that report abuse must stop.

The US Army denies veterans justice without anyone knowing it. The US Army Toxic Leadership must be eradicated. It should be equated to stage IV cancer. Cover-ups on military installations as well as the inspector general’s office, up to the US Military court of appeals clearly shows a system of corruption.

Generals must be removed for failure to eradicate this type of behavior. US Army toxic leadership must be eradicated. We the people must save the lives of American service members. American service members must be protected from US Army toxic leaders. Service members are being attacked from within the very ranks that are supposed to protect and care for them. It his horrible and horrific!!!

This egregious maltreatment from commanders must be eradicated. And looked at as a crime, they should be penalized for abusing their authority. Many service members that have tried to seek assistance in reporting abusive treatment from their command; not only lose their careers, but also have lost their freedom.

This request came from MAJ Ball of whom I worked for. After Irequested to go to JAG for a sworn statement and to speak with 25th Division CSMDevins about her treatment of me (I am a behavioral health specialist thatworked for her). From the time I started working for MAJ Ball in October 2011she has treated me with contempt (the feeling with which a person regardsanything considered mean, vile, or worthless; disdain; scorn.).I tried in October 2011 to relieve myself from her by asking my command toremove me from underneath her; however I was placed back under MAJ Ball on 08Dec 2011 only to be further mistreated. MAJ Ball's comments to me on 10 Jan 2012lead me go to JAG and request to speak to CSM Devins ON THE MORNING OF 11 Jan2012. After I returned from JAG she informed me that she was referring me for amental health evaluation.MAJ Ball who was already angry with me due to her comments and the fact I wentto JAG/requested to see CSM- than showed me the NOTICE OF COMMAND REFERRAL FORMENTAL HEALTH EVALUATION that she was creating. MAJ Ball created this evaluationunder retaliation of which is a violation of DOD DIRECTIVE 6490.1 AND 6490.4.Please see below information. While MAJ Ball was creating the false mental health evaluation she had me to sitin her office as she talked about me to SGT Velasquez on 11 Jan 2012.I asked MAJ Ball if she thought I had an AXIS I OR AXIS II OR AXIS IV or a lowGAF and she stated no.MAJ Ball informed me that I should not have gone to JAG nor requested to see CSMDevins. MAJ Ball told and showed me what she was placing on the TAMC FORM 108and laughed. MAJ Ball and SGT Velasquez informed me of who I would be seeing(CPT Zerga). MAJ Ball in an angry tone informed me that she use to work with CPTZerga and that she would know what to do with a soldier like me.My commander signed the evaluation on 12 Jan 2012 after speaking to MAJ Ball (hedid not create the evaluation).I than requested for the second time to be removed from under MAJ Ball; to bepulled out of the clinic.I have requested a copy of the assessment from CPT Zerga and was informed that Icould not get a copy of the assessment per Tripler policy (even under thefreedom of information act). CPT Zerga did inform me that she knew MAJ Ballwhen I asked her during the intake.REQUESTI am requesting that this matter be looked into and that I receive a copy of theassessment for my attorney. Hello Mr. Sheldon, I am a social worker supervising active duty intern at Madigan Army Medical Center in Tacoma, WA. I recently contacted your client concerning MAJ Rebecca Ball. MAJ Ball is currently stationed here and has been involved in my program. She has been the site supervisor for one of my interns. I contacted Ms. Pitt after finding her petition online and saw that she was bullied and harassed by MAJ Ball, and she is doing the same thing to my intern. Ms. Pitt asked that I speak with you, since she is not able to address all my questions. My primary question is, when will you file the lawsuit? Also, will you be notifying her Ball’s licensing board? She needs to lose her clinical license to practice. I appreciate any help.

Respectfully, Lorri S. Picha,

It is a prosecutor’s duty to pursue equity and justice so that all individuals can pursue their lives free from crime and without fear from oppression. Instead corrupted judges systematically provide advantages to those who have given them power. Not much attention to the insidious and hidden Deep State Plutocratic/Oligarch control of the US Army and its corresponding judiciary structure.

Unfair, ineffective and inefficient US Military justice system do not increase safety or well –being of soldiers and the unit. They are inconsistent with American ideals

Secretary Mark Esper, please reform the US military justice system; it is of an urgent matter. And, return me back to active duty with back pay and time and grade; to include a promotion to Colonel and allow me to go to law school; after the FBI completely investigate my history with the DOA.

I, greatly appreciate your attention to this matter, your support and a reply.

Sincerely,

Annzala L. Pitt
