Rick, we here in the US keep having a debate of who owns what and what they can do what aftermarket (after initial sale.)

I personally find coal rolling offensive and juvenile, but they do bring up a very valid point, what is Federal government’s role once it is out of manufacturer’s hands and into the general populace. Safety yes. Cant allow them to manufacturer aftermarket parts that do indeed kill people directly.

However, these tuners were sold labeled “for competitive only modifications” but marketed differently to defeat tests even at local and state levels, bypassing emissions laws already on the books (not to mention EPA complaint also included 12,000 vehicles they sold that did meet emission certification standards direct from manufacturer.)

Competition Only Mods have been allowed for decades and are not permitted as a normal driver, not by federal emissions, state or local laws. That is indeed regulation, but a separate set of rules. The EPA “clarification” that ensnared Harley and VW does indeed muddy the waters by commingling the two sets.
