Andrew, the Obama Administration’s strategy of getting the case to the Supreme Court was the right strategy. I strongly believe the Court will dismiss this because the Republicans have no business bringing their political disputes with the President into federal court and because they’ve based their entire case on a purposeful mischaracterization of the law. As Linda Greenhouse points out today in a brilliant piece in the NYT, at the end of the day the Republicans have no case and it’s up to the Roberts court to see through the “smoke screen” they’ve concocted.
