I just got back from the North American Bitcoin Conference and it was an amazing event. Over a few days in Miami, I met with ICO founders, hedge fund managers, VCs, investors, and entrepreneurs. The future seems incredibly bright. One of the topics as always was what is regulation going to look like in the next year. There is no doubt that in America, that SEC is coming, it is only a matter of time. The topic that was discussed at a lot of my meetings was the difference between a utility and equity token, and is the SEC going to come back to companies who raised millions of dollars on a utility token offering and say no-you were really a security. This is going to happen, the only question is to what extent.
Here is one of the first questions the SEC is going to ask.How did you market your token? Were there disclosures in place from the people you paid to market your token? What steps did you take to make sure the public was aware that what was being presented was a paid advertising campaign? This is where the problem of Bounty Campaigns come in, and why the SEC wants to put an end to Bounties. Bounties are not bad, they are very useful, but when the public is not being made aware that the bounty team is being paid to tout an ICO, that is a problem.
Proper ICO Marketing will always disclose the amount the publisher was paid, who paid them, and what the services were.Global Coin Media maintains not only a very effective marketing service but a highly compliant service where we disclose to the public that we are being paid to promote ICOs. There is nothing wrong with a paid ad campaign, companies do it all the time. Just disclose.
What you do not want to have happened is the SEC coming to you, and saying that your offering was actually a security, when you advertised it as a utility, and to go along with that problem, you ran a fraudulent marketing campaign.
The SEC is coming, start getting your ducks in a row. Compliant marketing like what is being used at www.globalcoinreport.com can be the difference between, a successful campaign, and a large fine or worse…
