This is because legal logic is no logic at all, the lawyers and judges rarely look at the big picture and unintended consequences of their rulings before handing them down. They seem to live in the moment of the decision and forget the future…Look at the ACA, clearly not correct, but they wanted to preserve it for continuity sake and look what it has given us. The ACA needs more than tweaking, it needs an enema; remember it is a tax bill and a wealth transfer bill that has been put in a dress, given a wig, and has lipstick and makeup on, and has been sent to the ladies room, trouble is the beard gave it away.
