Do your research! Ask the landlord if they have a relationship with the Better Business Bureau, then find the leasing company’s name on their website. Before you move in, your landlord will usually give you a document to record the state of your unit. Take detailed notes on the condition of your unit as well as photographs documenting any damage or concerns. Email your landlord if you have any concerns about the condition of your rental unit.
Be sure to give notice of end of tenancy to your landlord in the time required. Be sure to check your rental agreement to find the time needed. Mail your notice by certified mail and request a return receipt (evidence in case you end up in small claims court).
2. Know your Lease
Read your lease thoroughly, and make sure you understand detailed in it. You can make alterations within reason, for example, if your lease stipulates three months notice for end of tenancy, you may alter it to whatever the legal limit is for your state (Texas is 30 days notice). You may also make additions and subtractions to your lease.
3. Report Damages Immediately
Even if you don’t want something fixed, report all damages to your landlord in writing — either by email or certified mail. Take pictures to document the damage and the repair. If the landlord does not respond to your repair request, and you choose to make the repair yourself, again document before and after and send photos along with the bill to your landlord by certified mail.
4. Know Your Legal Rights
Usually two or three weeks after moving out, the landlord is required by law to send you: an itemized reciept of how your security deposit was used, if there is anything left of the deposit, and a list of deductions before they are made.
