the penalty for violating FERPA is precisely the same as the penalty for violating Title IX, which brings up an obvious question: Why wasn’t the commissioner concerned about losing those hundreds of millions of federal dollars when he overturned Johnson’s expulsion and demanded that the university re-adjudicate his case with a higher burden of proof — a clear violatiuon of Title IX?
