I like your critical approach to currently existing bodies of ethical rules and guidelines around data protection! In a technological world where everything keep changing constantly it is hard to stay “on top off things” from a legal perspective and I thus support your call for some kind of flexibility! I also think, topics like this should be more dominant in the open discussion — right now everyone seems to focus on the great (economic) benefit that lies hidden in the vast data resources of this (online) world! Maybe an interesting read that follows your argument that changing technological possibilities require a re-thinking in our regulatory approach: https://medium.com/@P.M.Kuss/how-your-texts-reveal-more-about-your-personality-than-you-think-and-more-than-you-might-like-5bf8b445e9c8#.rg8170tgm
