DACA and Trump…

I admit that I am starting to take the deportations personally, though family and friends are saying this is irrational. I encouraged folks to come out of the “shadows” — one particular person even told me that I was being naive and the government would eventually take away the dream yet I insisted that things would be alright.

I’ve been going to St. Luke’s in San Francisco. I’ve left my business cards. I’ve been pretty frank with God, this is the kind of thing that you are supposed to stop because no human force is able to stop this without a divine intervention.

There is no “legal” protection in churches or other religious buildings, like anywhere else, the INA Sec. 274. [8 U.S.C. 1324] clearly prohibits “(iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;” resulting consquences: “in the case of a violation of subparagraph (A)(ii), (iii), (iv), or (v)(II), 4/ be fined under title 18, United States Code, imprisoned not more than 5 years, or both.” Notably, at least the stepped up 10Y punishment for harboring an illegal alien for commerical reasons will not apply


As a lawyer, one feels a sense of responsibility for advising folks to “come out from the shadows.” Even if the risks had been clearly communicated, it still feels like a daily heartbreaking humiliation, though nothing compared to what the real victims of this move towards nativism and against American values are facing.
