At the Drug and Alcohol Testing Industry Association (DATIA) annual conference in Orlando, FL, Jennifer Livers-Lancaster, an FMCSA Enforcement and New Entrants Program Specialist provided an update for the much-anticipated FMCSA Clearing House. The update included details about access to the database, including the requirement for employers to perform an annual query of their driver pool. This annual query is intended to monitor drivers who may have drug or alcohol testing violations (49 CFR Part 382) from other employers for whom that driver may be performing regulated duties.

Smart Test also reports that his requirement is in addition to the anticipated requirement to perform a specific query on the violations background of an applicant.

The update also included an allowance for third-parties to perform the required monitoring on an employer’s behalf.
