What information should be included in a Lease Agreement?

This lease agreement is simple to use and has been translated into English and Thai. It provides all of the legal safeguards you need to rent your property with confidence:

1. Property address: The property address and the name of the owner or property manager must be included on each lease agreement form.

2. Security deposit: You must specify the amount of the security deposit and how it will be recovered once the renter has vacated. In the event of a lease break, our contract permits the landlord to keep the security deposit. In the case of a breach, a notice of hindrance or eviction of the tenant may be necessary.

3. Tenant information: You’ll need the full names of everyone who lives in the leasing property. The contract will safeguard visitors by demanding written consent from the landlord.

4. Rent payment: With our lease agreement form, all you have to do is specify when the rent is due. You can also specify the quantity of late fines and the due date.

5. Pet policies: As a landlord, you have the authority to decide whether or not a renter may bring a pet. If you have any issues regarding permitting pets in your property, the lease agreement will safeguard you from bringing in pets without your approval.

7. Parking: Include a specified place in your lease agreement if your renter has a parking space in the driveway of your condominium complex or residence.

8. Subletting: You have the option of allowing or prohibiting subletting of your property. Many property managers will not allow renters to rent out (all or part of) their home or condominium to someone with whom they do not have a lease agreement, thus you may wish to ban subletting. You may also wish to incorporate clauses that allow you to add new or additional tenants to a contract with your permission. If your Tenant has previously gotten approval from the Landlord to sublet the property, he can enter into a sublease agreement with a subtenant for a duration not exceeding the initial lease term.

What should I know before entering into a Lease Agreement?

In Thailand, whether the arrangement is referred to as a tenancy, lease, or rental agreement, it is controlled by the Civil and Commercial Code, chapter “Rental of Property.” A rental agreement between a tenant and a landlord is any arrangement in which the owner agrees to allow another person use the property for a specified length of time in exchange for rent.

A lease agreement in Thailand may include stipulations based on the parties’ basic freedom of contract as well as clauses based on specialized property rental legislation. The significance of the distinction rests in the future enforcement of contractual obligations and the fundamental law of property leasing.

A valid lease’s options and obligations are enforceable against all other persons and are legally binding on successors to the leased property (true leasehold rights follow the property along with ownership), and once granted, the owner (lessor) cannot renege on the lease option and cannot change his mind, contrary to the lease agreement’s contractual promises and potential future enforcement difficulties. The period agreed in the lease is regarded a basic right of the tenant under Thai law and Supreme Court judgements. An option to renew the lease, on the other hand, is regarded a contractual choice or duty (rather than a basic entitlement under the lease) that must be enforced in the future. A lease amendment can be used to adjust lease terms, renew or extend a lease in the future.

What to do after signing a Lease Agreement?

Following the signing of your lease agreement, ensure that you receive your payment on time, and do not be afraid to demand payment by sending a formal eviction notice if payment is late. Check that your renter is not breaching the lease agreement’s terms and conditions, and do not be afraid to directly question the neighbor or tenant. You can supply the renter with a monthly rent receipt as proof of payment. Keep all original rental agreement documents, including the rental application and house inspection report, with you so that you may keep the tenant’s security deposit in the event of property damage. If the renter commits major misbehavior, do not be afraid to cancel your contract by delivering a termination letter to the tenant. It is important to note that you have the right to keep the tenant’s security deposit to pay any harm caused by the tenant’s default.
