“Instantly, outlawing the use of fossil fuels would kill 99 percent of the worlds population within a month, and the final percent soon after.”

A straw man argument is one that creates a false position of their opponent from which to argue from. Nowhere in this decision is there a requirement to instantly outlaw the use of fossil fuels. The plantiffs seek “to phase out carbon emissions as soon as possible; to seek a drawdown in atmospheric carbon to 350 parts-per-million by the close of the century; and to enact a countrywide plan that will stabilize the climate system.” The wording “phase out” explicitly means that the change would not be done “instantly.” Essentially, such a lawsuit, upheld to its logical conclusion, would mean that we become legally obligated to pursue advanced technologies and gradually abandon unsustainable, fossil fuels.
