“Is CBD legal” is a bad title. Legal to what? To take? To produce? To have?

The federal government has yet to rule one way or the other to say whether hemp can be manufactured into food or pharmaceutical products. Which is a very important fact you did not mention.

For manufacturing, it does not matter if the CBD is hemp. Federally, you still may be able to get in trouble for making CBD even from hemp.

“Section 7606 [the “Farm Bill”] does not affect the requirements that already exist for the production of food and pharmaceutical products under the Federal Food, Drug, and Cosmetic Act or the Controlled Substances Act….Whether hemp may be grown for food and pharmaceutical products remains a question for the FDA and/or the DEA.” https://nifa.usda.gov/industrial-hemp
