The nuisance suit against Alameda and FTX was voluntarily dismissed with prejudice. As we wrote in our motion to dismiss filed on 2019–12–12, the complaint was misguided and simply incorrect about Alameda’s business model and actions in the cryptocurrency markets. Neither Alameda nor any of the other named defendants have ever manipulated the market for bitcoin or other cryptocurrencies. So we are grateful that, following the filing of our motion, the plaintiff dismissed the action, although we are not surprised, given that the allegations were not true.
