If they implement the policy in a discriminatory way the ACLU will sue and the courts will rule that the policy is unconstitutional. The reality is that it is possible to implement almost any law in a manner that is unconstitutional — suggesting that they “could” implement it illegally is certainly a weak argument against the policy.
