The biggest problem with this study is that it doesn’t take into account plea bargains. Most drug convictions are actually other crimes that are “negotiated” down. For example, a rape or assault occurs and the suspect ALSO is in possession of an illegal substance — the DA will often plead down the suspect to the drug crime — dropping the rape or assault to avoid the minimum sentencing requirements.
