Regarding the part about who actually uploaded the image — I know Pexels doesn’t allow users to upload images that they don’t own. So if someone other than the owner uploaded it, they would already be in violation of the Terms of Service (section 4.5). I can see how this violation may cause issues for the end users who didn’t know they were downloading and using a photo that shouldn’t have been up there to begin with. However, with paid stock photo sites there’s usually some coverage for the licensees.
