9 Pieces Of Damaging Evidence From Nick Carter’s Motion For Summary Judgment On Shannon Ruth Case

Nick Carter, a member of the biggest-selling boy band of all time — the Backstreet Boys, is currently facing allegations from three women stemming from alleged incidents in the early 2000s, has taken legal action alongside his team of attorneys. Concurrently, he is navigating court cases involving Melissa Schuman (formerly of the girl group Dream), Ashley Repp, and Shannon Ruth, the latter two being former fans of Aaron Carter, Nick’s late brother, and the Backstreet Boys.

On Tuesday, May 7, 2024, Carter addressed the allegations in a long-awaited social media post on Twitter/X, providing a link to a 46-page court document where he is requesting a hearing for motion summary judgment on Ruth’s claims.

Some of the highlights noted in the latest exhibits related to the Ruth trial, which also reference Schuman, her father Jerome, and an anonymous Twitter account ElaineM00 include:

#1 — Ruth Admits to Lying

An affidavit from Heather Hayat, a Backstreet Boys fan, who Ruth confided in on Twitter that Carter never raped her. There are screenshots of the messages. Shay Ruth Appendix 3, Page 6–7, 10); Nick Carter Counterclaim (Page 25–26; Feb, 2023);

#2 — Ruth’s 146 “I Don’t Remembers” and 64 “I Don’t Knows”

During Ruth’s deposition, she failed to recall critical details about the event, night in question, and her interactions with the Schumans and Repp. She remembered next to nothing, and reported contradictory information from previous testimonies and police reports. Ruth gave a description of a tour bus that Carter was not using on the particular tour. She also could not describe any intimate, physical details about Carter’s body. Ruth also inaccurately identified the security guard who allegedly allowed her on the tour bus, when this security guard was not present for this tour. #3 Ruth Admits She May Have Confused Rape

The Defense team asks Ruth if it’s possible that she is having false memories of Nick Carter, confusing it with the rape she allegedly had at the hands of her ex-husband, Adam Ruth. Her response: “I don’t know.” She would also not answer when the defense asked why she was suing Carter and not her ex-husband. (Exhibit for Summary Judgment 1, Page 83–188)

#4 Tour Production Manager Testimony

A statement from Tom Hudak, the production manager for the Backstreet Boys Black & Blue World Tour from January 2001 to November 2001. He testifies that her claims cannot be factually true given that the members of the Backstreet Boys were escorted from the stage each night of the tour and departed the venue immediately after each show. #5 Ruth’s BFF from High School Never Saw Her Warts And Was Offered Money

A transcript from Ruth’s high school friend, Eleanor Brewer, who was reported to be with her at the 2001 Black & Blue World Tour concert in Tacoma, Washington. In the transcript, Brewer testifies that she never knew Ruth had autism or cerebral palsy. She also testifies that Ruth never told her about genital warts she allegedly contracted due to the sexual assault, never showed them to her, and they never went to the doctor with her, which Ruth testified they did. (Exhibit Part 1: Page 42–58)

In Ruth’s deposition, the defense asked her if she had been tested for HPV more than once and it came back negative. She responded “I don’t know.” Medical records indicate that she had tested negative for HPV. (Exhibit Part 1: Page 83–188)

Brewer also testified that Ruth offered to share any money she received from winning her lawsuit with her and that it bothered her because “that’s not what I was in this for.” (Exhibit Part 1: Page 42–58)

#6 Ruth’s Other Friend Testifies About Inconsistencies in Ruth’s Testimony

An affidavit from Joy Leist, who helped with the Aaron Carter Street Team who became friends with Ruth. Ruth allegedly never told Liest that she had cerebral palsy or was autistic. Ruth claims that she began engaging in self-injurious behavior as a result of the alleged sexual assault occuring in February of 2001. Leist’s testimony indicates that she had first-hand knowledge that Ruth was cutting herself as early as Summer of 2000, almost a year prior to the Backstreet Boys concert. Leist was also at the Tacoma shows, but Ruth did not let her know that she would be attending. She stayed at the same hotel in Seattle, a 35-minute drive from Tacoma. She saw Carter walk into the Seattle hotel approximately 40 minutes after they left the concert a few songs before the show ended. (Joy Leist Sworn Affidavit Feb, 2023)

#7 Schuman Paid For Ruth’s Press Conference Look

A transcript from a videotaped deposition of Ruth where she admits Melissa Schuman paid for her hair to be done and her dress for the press conference she did in December 2022 where she announced she was sexually assaulted. (Exhibits for Summary Judgment Part 1: Page 61–81)

#8 Backstreet Boys Head of Security Testifies

Carlos Cardenas, who was the Backstreet Boys Head of Security from 1998 to October 2001, declared in an affidavit that Billy Evans was Carter’s security guard on the Black and Blue World Tour. Ruth has testified that it was the late Johnny “Q” Elgani, who was a strong and popular figure within the Backstreet Boys fandom, that was Nick’s security guard that night in Tacoma. She identified Elgani by photo, confirming he was in fact the guard who let her on the tour bus. At the time, Elgani was not working with the Backstreet Boys. Cardenas also gives more information on the process of being a Backstreet Boys security guard during the height of their fame. (Shay Ruth Appendix 3 Part 2; Pages 5–7 )

#9 Ruth Says She Wasn’t an Aaron Carter or Backstreet Boys Fan

In the deposition they ask Ruth if she was a fan of Aaron Carter since she helped with his street team in the early 2000s. She claimed she didn’t know if she was a fan. She also claims she was not a Backstreet Boys fan or a Nick Carter fan. However, both of her friends, Brewer and Leist testified that Ruth was a big fan and would regularly talk about the performers.
