Publishers aren’t in a position (at the moment) to compel these kinds of deal benefits, as most of their market (public performance and mechanicals) is regulated. They *want* what the labels have in direct negotiation, and have said as much publicly. Once again, the issue is, if you talk to smart folks like Songwriters Guild of America and Music Creators of North America, one of transparency. Maybe the deal is awesome. But do the writers know what’s in it? Are they cut into these additional benefits? Were those sweeteners traded for lower per-play rates? Do they open up the possibility of publishers bypassing the PROs, and therefore, eroding the direct payment and 50–50 non-recoupable splits? It’s not that these are bad deals, necessarily. But creators need to at least know what’s in them to make a call either way.
