Social media, such as Twitter is given a limited license for their own personal use.

Any direct copying without explicit permission is disallowed. Any violation and copy using electronic methods such as the use of a replay bot to illegally copy in a manner that bypasses controls is a breach of the provisions of the Digital Millennium Copyright Act (USA) will be acted on. The DMCA prohibits trafficking in devices or tools that help other people circumvent access-control and copy-control measures. 17 U.S.C. § 1201(a)(2), (b).

The act states:

No person shall circumvent a technological measure that effectively controls access to a work protected under this title. The prohibition contained in the preceding sentence shall take effect at the end of the 2-year period beginning on the date of the enactment of this chapter.

No license granted by social networks such as Twitter for any material posted upon their sites may be replayed using any botnet method that is designed to bypass security controls such as blocking or privacy controls. Any violation will lead to criminal prosecution.

This includes Twitter Bots and is a criminal offence in the USA.

Individuals who have been blocked or otherwise restricted through privacy controls in any social media site are explicitly disallowed from access to content. No license will be granted for any such violation of privacy under the terms of the EU and UK privacy provisions and any such breach will be considered a criminal violation and acted on appropriately.

Uses such as Parody and Satire are covered under copyright law. A direct copy of material is not allowed under the DMCA. This maybe covered under fair use however any violation of access through the breaching of access controls will be dealt with under the law. Parody does not include direct copy and quotation of material. Any false copy used in harassment or cyber bullying will be prosecuted to the full extent of the law. This is covered under the Protection from Harassment Act 1997 (PHA).

Where notification has been provided, a failure to act under a valid takedown notice will be considered as willful liability.
