§1 General information

1. These terms and conditions specify the conditions under which the promotion “$50 Promo” (“the Promotion”) takes place.
2. The Sponsor of the Promotion is Bizzaria Ltd, a limited liability company, incorporated in Malta and subject to Maltese law, registration number C86735, having its registered address Ground Floor, Palace Court, Church Street, St. Julian’s STJ3049, Malta, (“the Company”).

§2 Duration of the promotion

1. The Promotion runs from 13th of August 2019 until the relevant information about the end of the promotion appears on https://base.darbfinance.com (“the Website”) or untill the promotional prize pool is distributed (500 000 USD).
2. The organizer reserves the right to extend the duration of the Promotion. The Promotion is extended by posting relevant information on Website.
3. The Company reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion should virus, bug, non-authorized human intervention, fraud, or other cause beyond Company’s control corrupt or affect the administration, security, fairness, or proper conduct of the Promotion.

§3 Promotion rules

1. Only new customers can participate in the Promotion (“the Participant”).
2. A Participant is a person who sets up an account on the platform on or after the 13th of August 2019 (“the Eligible Account”).
3. To avoid any doubts, the date of setting up the account is the day of setting up the account on the platform, not the day of activating the account by clicking the activation link in the welcome email received by the Participant from the platform.
4. This Promotion is open only to those who are 18 as of the date of entry. The Promotion is only open to legal residents of world wide, and is void where prohibited by law.
5. Each Participant of the promotion may have only one account on the Darb Finance platform.
6. The condition of proper application for the Promotion is the acceptance of the Terms and conditions “$50 Promo” in full by marking the consent in the icon placed after the regulations on the Website.
7. The Participant may withdraw promotional funds in the amount of $ 50 (“the Prize”) after trading the volume of $ 20 000 or more on the platform within 3 calendar months from the date of setting up an Eligible Account on the platform.
8. In case Participant does not trade the volume of $ 20 000 or more on the platform within 3 calendar months:
   a) granted $50 shall be removed from Participant account balance
   b) achieved benefits from trading shall be reduced proportionally to usage of granted $50
9. To withdraw the Prize from the platform, the Participant must additionally successfully complete the KYC process on the platform.
10. Any and all prize-related expenses, including without limitation any and all local taxes, shall be the sole responsibility of the Participant.

§4 Exclusion from Promotion

1. The Organizer may exclude a Participant from the Promotion if the Participant:
   a) violates the provisions of these terms and conditions;
   b) otherwise violates mandatory provisions of law in connection with the Promotion.
   c) if the Participant has taken any actions to circumvent security or affecting data falsification.
2. The Company has the right, in its sole discretion, to maintain the integrity of the Promotion, to void Participant account for any reason, including, but not limited to: the use of bots, macros, scripts, or other technical means. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws. Should such attempt be made, the Company reserves the right to seek damages to the fullest extent permitted by law.
3. Employees of the Company, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Promotion.

§5 Limitation of Liability

1. The Company shall have no liability for Participant failure to receive notices due to spam, junk e-mail or other security settings or for Participant provision of incorrect or otherwise non-functioning contact information.
2. By entering, Participant agree to release and hold harmless the Company and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from:
   a) such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof;
   b) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment;
   c) the unavailability or inaccessibility of any transmissions, telephone, or Internet service;
   d) unauthorized human intervention in any part of the entry process or the Promotion;
   e) electronic or human error in the administration of the Promotion or the processing of entries.

§6 Final Provisions

1. These Terms and Conditions specify will be available at the Website.
2. Every user will be informed about the changes in the Terms and Conditions “$50 Promo” at the Website.
   The message will include information about all changes in the Terms and Conditions “$50 Promo”. The information will contain a list of changes and will be posted on the Website for at least 14 days. Participant will be additionally notified by Company by an e-mail message. Company will use the e-mail that was indicated in the registration form. The e-mail message will include information about all changes in the Terms and Conditions “$50 Promo”.
3. This Promotion is governed by the laws of Malta, without respect to conflict of law doctrines. As a condition of participating in this Promotion, Participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Malta having jurisdiction. Further, in any such dispute, under no circumstances shall Participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Promotion). Participant further waives all rights to have damages multiplied or increased.
4. Information submitted with an entry is subject to the Privacy Policy stated on Company’s website.
5. By participating in the contest, the Participant agree to be fully unconditionally bound by these Rules, and represent and warrant that Participant meet the eligibility requirements. In addition, Participant agree to accept the decisions of Company as final and binding as it relates to the content of this Promotion.
6. Note that $50 promo is not an airdrop.
7. The promotion cannot be combined with the affiliate program and Daily Revenue Share. For promotional funds, DARB Token is not generated until promotion ends.
