Kaepernick has the First Amendment right to speak or not speak, to stand or not stand; and those who disagree with him have the right to criticize him for what he did or did not do. But, the bottom line is that his statistics in 2015 and so far this pre-season are terrible (2012–2014 weren’t bad, although there was a steady decline), and he does not have much time left in the NFL due to his declining level of play and the fact that many of his teammates no longer follow him as a leader.
