Hmm…you say you havent prejudged Rose, then say the occurrence of rape is highly likely? Serious logical disconnect there. And yes, the context of that text message seriously weakens a presumption of rape for two reasons: 1) it shows that her assertions of refusing group sex are not credible as it appears she was all for it and Rose was not (and the message is from the night/morning of the alleged rape) and 2) the text was sent at 2AM —directly before the alleged rape and during a period of time she claimed to be black-out drunk. The message shows she is not credible and further, the fact that she and her counsel withheld it in violation of a court production order shows that she has something to hide. She knew that text message hurt her story.Why would a true victim conceal evidence?
