During a recent EOS governance discussion with the Chinese community, EOS New York proposed a new version of the constitution known as the EOS User Agreement v2.0. The proposal has gained traction as a viable replacement of the current EOS constitution.

Kevin Rose, Co-founder and Head of Community for EOS New York, shared the EOS User Agreement v2.0 with the Chinese community during the weekly EOS Alliance meeting.

Summary:

  1. EOS NY wrote the EOS User Agreement (EUA) because they felt that the current EOS constitution is not very effective.
  2. They believe governance should be simple.
  3. “Governance establishes the methods by which the community will arrive at a decision,” — Kevin Rose.
  4. The perceived failures of EOS governance are not a failure of the system of governance itself, but a failure to manage the expectations of what EOS governance is.
  5. All blockchains are governed blockchains. Consensus mechanisms like POW, POS and DPOS are all methods to arrive at a decision. Example: A decision on whether or not a transaction is valid, or whether or not a protocol should be changed.
  6. The reason why EOS is a better governed blockchain than most is that in DPOS, the stakeholder and the protocol decision maker are ONE. In DPOS, you are able to delegate your authority to select network validators; if the validators no longer represent the token holders interests, then users can remove their votes. In Bitcoin there is a separation between the stakeholder and the validator of the networks.
  7. The purpose of the EUA is to simplify the current Constitution. It is not a set of rules; rather, it is a reflection of EOS’ current reality. The EOS User Agreement is not a change to what we do. It is simply a reflection of what we already can do.
  8. The largest changes are the removal of rules like you shall not lie, you shall not be violent, etc. It’s not because we want people to be violent, it’s because it’s not helpful to have those kinds of rules written in the Constitution. The EOS blockchain cannot prevent violence, it cannot stop lying. We need to be realistic.
  9. The mention of dispute resolution has been completely removed. It is not a concern of the protocol. It is important to individuals, but it is not important to the entire blockchain.
  10. Any mention of referendum is removed. There is no referendum within this agreement and the reason why is because the 15 percent threshold does not actually matter. Example: Right now 155 million tokens must vote for a referendum so that block producers can implement it. Now imagine the referendum only gets 145 million votes. This is still a lot of votes for the proposal. A standby block producer can raise his or her hand and say, “I will implement the proposal if I’m voted in to the top 21.” There’s nothing to stop token holders from voting to switch out the top 21 and the referendum will pass.
  11. The referendum is still important to block producers because it gives them insight to the popularity of a change. BPs are individual independent groups; they have their own personal limits. If something hits 9% participation and the block producer says, “that’s enough for me I will vote YES on this” then it may pass.
  12. There should not be an expectation that 15 block producers will use their privileges to change private keys of an accounts. This should be a golden rule.
  13. To create an account recovery system for your own account, you can create a multi-sig.
  14. We need to take a very long look at what our expectations are for EOS governance. The EOS User Agreement outlines three important aspects of blockchain governance; resilience, practicality, and enforceability.
