I think one could make a reasonable argument that Roosevelt didn’t ever think the plan would actually happen. I see it as more of a threat, an indication to the Supreme Court that they should make some sort of an effort to respond to public opinion and the activities of the other branch. Can you imagine a world where the earlier agitation and the court-packing plan didn’t happen, where civil rights, the New Deal, the Great Society, environmental regulation, etc. etc. was all invalidated by a backwards Supreme Court? The nation might have done away with the Court entirely.
