Privacy Policy

This Privacy Policy explains how we as Why Not Labs approach the privacy of our customers who download our app(s). Please read this Privacy Policy before using our apps and contact us if you have any questions. Please make sure that you read our Terms and Conditions document, which sets out the contract between you and Why Not Labs.

2. We may change this policy from time to time by updating this policy, and we will let you know when we do so.

3. As Why Not Labs, we develop augmented reality based mobile games. Due to the nature of augmented reality technology, our game(s) reach your device’s camera. Protecting your privacy is important to us. To ensure your privacy, we never capture or transfer your images and videos.

4. We operate the Freak Hunt app which collects only the following personal data:

· information you give us when you provide us with feedback or report problems, including your contact details and information about your experience when using the app.

· legal information such as a record that you have agreed to our Terms and Conditions or if you confirm to us that you have obtained the consent of a third party.

5. We use your personal data -mentioned above- to respond to your inquiries, comments, feedback, or questions, and for marketing purposes. We may contact you to provide the information we believe will be of interest to you. For instance, we may use that information to send you promotional information about our products and services unless you unsubscribe from our email lists or let us know you do not like to hear from us.

6. We do not share your personal data with third parties.

7. We keep personal data for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a legitimate business need to do so.

8. If you have elected to receive marketing communications from us, we retain information about your marketing preferences until you opt-out of receiving these communications and in accordance with our policies.

9. If you need to change or correct your personal data or wish to have it deleted from our systems, you may contact us at contactwhynotlabs@gmail.com. We will address your request as required by applicable law.

Terms & Conditions

1. Freak Hunt is an augmented reality game, developed and presented by Why Not Labs. To contact us send an email to freakhuntgame@gmail.com

2. These Terms and Conditions apply to your access and use of the Freak Hunt app. If you use Freak Hunt, then you agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, please delete the Freak Hunt app from your device(s) and do not use the app.

3. The Freak Hunt app includes in-app purchase options. It is your responsibility to pay for these in-app purchase items. If you are under 18 and do not pay your Apple spending such as in-app purchases, make sure that your parent/guardian has given their permission and has read and agreed to these Terms and Conditions. If you are not the App Store account holder of the device you are using, make sure that you get permission from the owner while playing the game and purchasing any items. If you do not have permission, do not buy any virtual items.

5. When you are using the Freak Hunt app, please make sure that you play safely. It is your responsibility to ensure your security. We do not accept responsibility for any damage that results from your own actions.

6. Freak Hunt is an Augmented Reality app that requires to accesses your device’s camera. We never capture, keep or transform any image or video. We take your privacy very seriously. Please see our Privacy Policy below for the details of how we approach your privacy.

7. If you are using the Freak Hunt app in a place where the use of mobile devices or cameras is not allowed, it is your responsibility to bear the consequences, such as facing various penalties. Make sure that you do not break any predefined rules while you are using the Freak Hunt game.

8. It is free to download and play the Freak Hunt app. To help your progress in the game, in-app purchase options are offered. Through these options, you can buy virtual items including bullets, weapons, etc.

9.You are responsible for and agree to pay for anything that is bought through your device(s) whether or not these purchases are authorized by you.

10. Purchases of virtual items are made through the App Store and are subject to the App Store’s payment terms and conditions, which you should read before you make any payments. Why Not Labs is not a party to and is not responsible for the payment arrangements and transactions. Why Not Labs does not control how you pay or how you get the items. If you face any problem during in-app purchase payments, contact Apple.

11. Prices for virtual items are shown in local currency and do not include taxes or changes that apply in the country you access the Freak Hunt app. Prices for virtual items which might change from time to time are displayed in the app.

12. When you buy or earn Virtual Items, we give you a non-exclusive, personal, non-transferable, non-sub-licensable, and revocable license to use these virtual items to play the Freak Hunt app but you do not own these virtual items.

13. If you change your device and download the Freak Hunt app to your new device, all virtual items you purchased via in-app purchases except Unlimited Ammo and Thunder Weapon will be lost, and your recorded score on the leaderboard will be lost.

14. We may make changes to these Terms and Conditions in the future, and we will notify you by publishing the amended terms on the Freak Hunt app. It is important that you read any updated terms before you continue to use the Freak Hunt app.

15. We might also develop and make changes to the Freak Hunt app, such as adding new or deleting existing features, adding or removing virtual products or changing or adding new rules of the game. Updates to the Freak Hunt app may be available on the App Store.

16. Virtual items are payable in advance and have no “real world” cash or other value outside of the Freak Hunt game. Virtual Items cannot be changed back into cash or other currency. Purchases of virtual items are final and not refundable once the payment has been processed and cannot be given or sold to anyone else. You shall not offer to buy, sell or transfer any virtual items to anyone else.

17. We are not liable for any virtual items that you lose, or which are spent, including as a result of any gameplay interruptions or game termination, however caused.

18. You agree that we do not have to give you any refund for or any other compensation relating to virtual items, including when your account is suspended or terminated and/or if you stop using and/or delete the Freak Hunt app.

19. Your service provider may charge you for data usage when you play Freak Hunt on a device that is not connected to Wi-Fi. You are responsible for the payment of any other fees relating to the use of Freak Hunt, such as internet and data costs and data roaming costs.

20. As Why Not Labs, we own the copyright and other intellectual property rights in the Freak Hunt. You agree that you do not have and do not will to have any rights in the Freak Hunt except the limited license we give to you which is a non-exclusive, non-transferable, personal license for your own personal, non-commercial entertainment purposes to download, access and use the Freak Hunt app.

21. We can terminate this license by giving you notice at any time.

22. You can use the Freak Hunt app as allowed in the Terms & Conditions, and you agree not to;

· use the app for illegal or other unauthorized purposes and any commercial purpose.

· remove or attempt to remove any copyright, trademark or other notices within the App

copy, modify or create a derivative work of the app or any part of it
sell, rent, license, distribute, lend or transfer any rights of the app or any part of it to anyone else
disassemble, reverse engineer or decompile the app, or otherwise attempt to gain access to the source code, structure or algorithms of the underlying software of the app
attempt to access or tamper with any feature, content or area of the app or our systems that you are not authorized to access
attempt to gain access to the source code, structure or algorithms of the underlying software of the app
use the app or any of its content in any manner to or to incite others to, attack, harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other person, including based on their race, ethnicity, national origin, religious affiliation, sexual orientation, sex, gender, gender identity or disabilities.
use the app to promote, arrange or discuss terrorism or terrorist acts or otherwise to host terrorist content;
use the app or any of its content to create libelous, defamatory, obscene, discriminatory, indecent, suggestive, harassing, bullying, threatening, abusive, inflammatory, fraudulent, or illegal material, or any material that infringes or violates another person’s rights (including, intellectual property rights, or rights of privacy or publicity)

23. We would love to hear your feedback and comments about the Freak Hunt app. You may submit error reports, questions, comments, suggestions, ideas, original or creative materials, or other information about Freak Hunt by emailing us at contactwhynotlabs@gmail.com. We may also collect analytical data about your use of Freak Hunt through monitoring how you play the game and use Freak Hunt.

24. You agree that we may use any analytical data we gather and any feedback, comments, suggestions, ideas, original or creative materials or other information about Freak Hunt which you provide to us whether through the contact process or otherwise e.g., online reviews for any purpose, including to improve Freak Hunt and/or our other products and services, without acknowledging or payment to you.

25. We would appreciate it if you could give us a chance to fix errors or other areas you are unhappy with before you leave any reviews about Freak Hunt.

26. Freak Hunt may contain links to third-party websites such as social media platforms. These third-party websites are not under our control, and we are not responsible for and do not endorse their content or their privacy policies (if any). You should make your own mind up about how you access and use any third-party websites, including the purchase and use of any products or services accessible through them.

27. Although making sure that Freak Hunt runs smoothly is our responsibility and liability, we cannot guarantee this. Freak Hunt is provided on an as-is and as available basis with no warranties of any kind. You agree that you use the Freak Hunt app at your own risk and we will not be liable for the completeness, accuracy, availability, speed, security or reliability of the app; any harm to your device(s), loss of data, or other harm that results from your access to or use of the app and any events outside of our reasonable control.

28. To the extent permitted by applicable law, Why Not Labs and our parties including employees, partners are not and will not be liable whether in contract, tort (including negligence) or otherwise, for any direct, indirect, incidental, special or consequential loss or damages, including without limitation, loss of data, loss of use, loss of anticipated savings, accrued but wasted expenditure, cost of getting substitute goods or services, loss of goodwill, or other intangible losses, relating to your access to or use of Freak Hunt and/or any content contained on Freak Hunt, whether or not we knew of or ought to have known of the possibility of such damages.

29. Nothing in these Terms and Conditions excludes or limit our liability for death, personal injury, or fraudulent misrepresentation caused by our negligence nor exclude or limit our liability for any other things where the law does not permit us to do so.

30. You agree to indemnify and hold the Why Not Lab Parties harmless from any claim, including legal fees, arising out of any breach or alleged breach by you of these Terms and Conditions, your use of the app, your behavior in the app and your breach of any law or the rights of a third party.

31. These terms of use and Privacy Policy are the entire agreement between you and Why Not Labs. As Why Not Labs, we can transfer our rights under this agreement to others (if we sell all or part of our business to someone else). You cannot transfer any of your rights under this agreement to any third party.

32. If any of these Terms and Conditions are not enforceable, the rest will remain in place in full force and effect. If we do not enforce any of the terms or delay in doing so, this will not constitute a waiver of our rights.

33. The Terms are concluded between Why Not Labs and you only, and not with Apple, and, as between Apple and us, we are solely responsible for the app and the content thereof.

34. The license granted to you for the app under the Terms and Conditions is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Apple Usage Rules set out in the App Store Terms of Service, except that such app may be accessed, acquired, and used by other accounts associated with the purchaser via “Family Sharing” or volume purchasing.

35. Apple and its subsidiaries are third-party beneficiaries of the Terms and Conditions and will have the right (and will be deemed to have accepted the right) to enforce these Terms and Conditions against you as a third-party beneficiary thereof.

36. We take intellectual property rights very seriously. Below is a list of license details of the artworks we used including 3D images and sound effects:
