I agree that there is no substitute for evidence, whether paperwork or DNA- based. But it is also the case that an average individual alive in 1850, whether Cherokee or whatever, would be likely to have literally hundreds of descendants alive today (due to family sizes, remarriages, etc) — so it seems to me quite reasonable that there would be more people with Native American genes around than you might expect, as hundreds of (e.g.) Cherokee could easily mean tens of thousands of descendants.
