AN Buildwell Promoters Divide and Rule will only kill our chances of getting our homes

The two projects, Spire Woods and Spire Edge that were launched by the AN Buildwell Pvt. Ltd, have only caused distress and suffering to us, its customers. While we have our investments and interests wedged in these projects, several efforts have been made by everyone to bring these projects to completion and to get the ownership of our homes and units that we bought. However, due to lack of action on account of the promoters and shareholders, the process has further been hard and strenuous. As we all formed customer associations, including the Spire Woods Buyers Association (SWBA) and the Federation of Spire Edge Associations (FOSECA), representing all the interests of majority of creditors with the aim of taking charge of the project in our own hands, and initiating action against the promoters who have led us all into this state of agony. To accomplish this we submitted the revival plan of AN Buildwell so as to stop its liquidation and to not allow the promoters to dust their hands off their responsibility so easily. The main reason of the promoters to liquidate AN Buildwell was to escape from their liabilities towards the customers and to cover up their acts of mismanagement. The promoters have always been against the revival plan even when it has been the best course of action because the revival plan would simply hand over the control of these projects to the customer associations.

Having been unsuccessful with this attempt, and as the revival scheme filed by all the customer associations was heard and approved by Delhi High Court, the promoters are now trying other ways through which they can foil our plans. One such bluff was exposed wherein these promoters have been supporting a faction of customers of Spire Woods Residents Association, which is a proxy group formed by the promoters themselves. The intention behind this has been to create distrust amongst the customers and delay taking any action towards completion of the projects under the ploy of these handfuls of customers. Their plan is simple; create barriers amongst the customers so that they can cash in more time and delay taking any action towards completion of the projects. If they become successful in their tactics then it is only going to kill our chances of getting our homes and properties.

Furthermore, the promoters delayed their action by almost a year after they tried to win the sympathy of customers by promising to de-water the waterlogged sites. With our joint efforts, we were able to highlight this fact to the High Court and due to which, very stringent instructions have been ordered to the owners by the High Court. Promoters were not interested in any de-watering instead they wanted to play their cheap tactics to win confidence of few buyers who still believe that the promoters of AN Buildwell will help them get their homes! Promoters have ignored court’s order for de-watering the sites within 3 days & required treatment so that there is no water logging in the future.

Judiciaries have also taken cognizance of the siphoning of funds by the promoters and have ordered the Provisional Liquidator to investigate the affairs of AN Buildwell and submit a report. This has been possible only because of all the customers working in unison. But if we get side-lined from our goal then it will definitely be tough to get our homes and properties back as the promoters will try to divide and rule.

So let us hold hands and continue on this journey together without letting any external force to disrupt our mission of getting back our rightful properties and earnings.
