According to the constitution, the president had the authority to issue his order, and the courts have the authority to rule whether he overstepped that authority. The executive has always had a very high level of autonomous authority.

I do think, however, that congress has been quite lazy over the past few decades, and ceded greater authority than constitutionally intended. The president may have the power to appoint an attorney general, but the power of the judiciary is out of his control.
