In a recent legal arena, the Delhi High Court has sentenced a significant verdict to a woman for one month of imprisonment for her breach of a divorce settlement agreement with her estranged husband. This decision was delivered on August 9 by Justice Manmeet Pritam Singh Arora, also saw the imposition of a fine of Rs. 2000 on the woman, holding her in contempt of court.

The court’s decision was based on the woman’s defiance of the terms stipulated in the divorce settlement agreement and her refusal to adhere to undertakings provided to a family court. Justice Arora noted that despite being afforded numerous opportunities to comply with the settlement terms, the respondent woman willfully violated the agreement and acted in disregard of her obligations.

The court’s analysis centered on the woman’s deliberate disobedience of an undertaking provided to the Family Court, intended to enhance her financial settlement with her estranged husband. This disobedience occurred despite the woman having various chances to rectify her actions and comply with the agreement.

As a result of her actions, the court deemed that a mere fine of Rs. 2000 would not adequately serve the interests of justice. Consequently, a one-month jail sentence was necessary. However, Justice Arora decided to suspend the sentence for a two-week period, granting the woman the opportunity to rectify her contempt after proceeding.

The court’s ruling emphasized the possibility of recalling the imprisonment sentence if the woman were to offer an unconditional apology and fully comply with the terms and conditions of the divorce settlement agreement. It was also noted that if the woman failed to tender an apology, she would be required to surrender before the Registrar General of the Court on a specified date, after which she would be sent to Central Jail, Tihar in New Delhi to serve her prison term.

Furthermore, the court directed the woman to appear before the Registrar General to furnish a security bond and a surety amount, indicating the gravity of the matter and ensuring compliance. Women should get connect with the best divorce lawyer to comprehend all the legal procedure.
