Anyone who believes that the Second Amendment has anything to do with the individual right to self defense is wrong. Heller was incorrect in that opinion. The Second Amendment protects a state’s right to maintain a well regulated militia, period. The individual right is protected by the Ninth as it is an unenumerated right. The reason that Scalia and the other “conservatives” and “originalists” incorrectly place it is because, ironically, they can’t accept the Ninth Amendment for precisely what it is, an ink blot that protects unenumerated rights as intended by James Madison. A future court will have to reverse that ruling and correct it as I state here.
