Blackberry plead against Nokia for Patent Infringement

The Canadian phone maker Blackberry sued against the obsolete king of the smartphone market Nokia for infringing of the patents relating to networking gear. Blackberry filed a suit in a federal court in Delaware, US.
The once booming mobile company Blackberry and Nokia are in the headlines again, but this time for the legal fight. Blackberry is prosecuting Nokia in the United States for infringing 11 of the Canadian company’s patents for mobile networking technology.
Today, in the world of smartphone makers Blackberry and Nokia stands nowhere in front of the real masters like Apple, Samsung. Now, Blackberry is more into the software market.
Blackberry and Nokia are now licensing their smartphone business to the third parties with a hope that will make their glory days back. But, there is one thing that never gets old, patent, there is still a wealth to sue for.
The pleaded documents show Blackberry doesn’t want to restrain the use of the networking gear but to obtain the royalty for the same.
In fact BlackBerry is also likely looking to get Nokia to start licensing the patents, some of which were acquired from Nortel after the company went insolvent in 2011.
As Blackberry, no more in the field of making handsets, they hit an attempt to scrunch some liquid assets from its patents, despite the fact that how much compensation is Blackberry looking for.
The battle between Blackberry and Nokia appears to be a match between veteran players who are at the fag end of their careers, still trying to make their mark.
Blackberry also suspiciously alleged that Nokia is aware of the inventions as it has cited some of the patents in a few of its own patent application.Earlier Nokia had tried to acquire the patents, but that was a part of an unsuccessful pact to obtain Nortel’s business.Blackberry, Apple and Microsoft were a part of Rockstar Consortium, which obtained some of the patents from Nortel.
This is not the first time the smartphone market pioneers becomes the monsters to cut the rival. Last year, Nokia also slapped Apple with a lawsuit over the infringement of patents. In 2013, Rockstar sued Google for the violation of the patent laws.
Blackberry has choice to get the remedies for the patent infringements under Patents Act,1970
· Granting Interim Injunctions, preventing the Nokia for further use of the patented mobile networking gears. This injunction made during the trial of the proceeding.
· Permanent Injunctions, the court may hammer out the agreement under which infringing party will pay the royalties in exchange for the infringing product.
For BlackBerry, it is important to be able to make new revenue as they are at the edge of losing its charm in the market and that may compensate for the announced goodbye to its mobile device business from the market.
If the willingness of the Canadian company Blackberry, to get Nokia to start licensing their patents, really come about the patent agreement with the Finnish company Nokia would certainly be good news for BlackBerry.
