Bills head to Senate accompanied by applause from stakeholders

The House has unanimously passed the Music Modernization Act, a compromise bill that creates a framework for better compensating artists for digital plays of their music and making it easier for music rights organizations to collect those fees from distributors of streamed music like Pandora and Spotify, as they do from traditional plays on TV and radio.

The bill has been billed as the most significant change in music licensing laws in decades, and drew praise from a chorus of stakeholders. It now heads to the Senate, where it is also expected to pass.

It actually incorporates a trio of bills. The base Modernization Act creates a single licensing entity for reproduction rights for digital uses, like those of Spotify, Pandora, Google, Apple and Amazon. It also randomly assigns judges to preside over ASCAP and BMI rate-setting cases, according to the Recording Industry Association of America (RIAA).

The package also includes The CLASSICS (Compensating Legacy Artists for their Songs, Service, and Important Contributions to Society) Act which compensates artists for pre-1972 recordings, which had previously not been eligible for digital royalties.

Then there was the AMP (Allocation for Music Producer) Act, which allows for direct payment of royalties to music producers and engineers.

“NAB applauds the House passage of the Music Modernization Act, which provides a consensus solution to music licensing issues facing songwriters, music publishers, and on-demand streaming services,” said National Association of Broadcasters President Gordon Smith….  œWe look forward to working with lawmakers in the Senate to advance this important legislation.”

“With this unanimous vote, we are one step closer to a once-in-a-generation reform of our music licensing laws,” said RIAA in a statement. “It’s a long time coming and we have much work to do, but the breadth and depth of unprecedented legislative support demonstrated over the last two weeks is illustrative. It is the result of a broken system that poorly serves creators and years of painstaking consensus-building by a many key members of Congress. This bill has advanced as far it has because its component parts reflect reforms of the entire music ecosystem. That is an essential ingredient.”

“This is an historic day for music creators,” said MusicFIRST Executive Director Chris Israel. “An overwhelming majority of Republicans and Democrats voted to bring U.S. music licensing into the 21st century and deliver justice for legacy music creators.”

“Today’s passage of the Music Modernization Act by such a significant margin underscores the widespread consensus that our music licensing system needs immediate updating,” said ASCAP CEO Elizabeth Matthews. “After years of advocating for reform, we are thrilled that our country’s leaders are now paving the way for a brighter future for music creators who have struggled under outdated laws for far too long.

“[T]he Music Modernization Act will ensure fans and artists can take full advantage of streaming to create, discover and enjoy music and that we continue streaming forward into the future,” said Chris Harrison, CEO of the Digital Media Association, which represents Amazon, Apple, Google, Microsoft, Napster, Pandora and Spotify. “As the Senate considers the MMA, we look forward to working with Senators Hatch (R-UT), Whitehouse (D-RI), Alexander (R-TN) and Coons (D-DE) to make sure it successfully passes the Senate and gets signed into law.”

“The House passage of the Music Modernization Act is truly historic for songwriters and the entire music ecosystem which they fuel,” said David Israelite, president of the National Music Publishers Association. “The MMA improves how songwriters are paid and how their work is valued, both of which are long overdue. The bill also helps digital streaming companies by giving them access to all the music their consumers want to enjoy.”

A fine has been tentatively assessed by the Federal Communications Commission against an alleged illegal radio operator in northern New Jersey. It includes an extra penalty for ignoring FCC warnings; but Commissioner Michael O’Rielly thinks it’s still not enough.

On April 25, the FCC says, it sent a notice of apparent liability for forfeiture to Winston Tulloch for allegedly operating on 90.9 MHz in Paterson, N.J., after repeatedly warning him that his operation exceeded legal limits for unlicensed operation. The commission said that his “apparent deliberate disregard” of its warnings warranted the $25,000 penalty. Commissioner Michael O’Rielly, noting news reports about the fine, tweeted: “Multiple warnings and complaints & then tiny fine? Great work by FCC Enforcement Bureau in taking action, but I’ve testified that we need greater tools in toolbox to stop pirate radio ‘stations’!”

It was in February 2015 that the commission received a complaint from a consumer that several unauthorized stations were operating in Paterson. Agents from the New York office began investigating and observed what appeared to be an unauthorized broadcast on 90.9 MHz in the city of 147,000 not far from New York. They determined the signal was coming from a multifamily unit, where agents also photographed an FM broadcast antenna on the roof. After measuring the strength of the signal, agents determined that the transmissions exceeded the limits for operation under Part 15.

The FCC agents returned in October 2014 and in January and April 2016 and found the station was still operating. On each occasion, it says, they recorded a portion of the transmissions, during which an announcer solicited advertising and gave a phone number. That number led agents to conclude that Tulloch was the operator; they said his car was also parked at the location during several of their visits.

A followup visit found that the station still operating but had from a separate multifamily complex a few streets away. At that time, agents issued a formal Notice of Unlicensed Radio Operation to Tulloch, which said that if he continued he would be subject to additional enforcement action. By May 2017, the station was still operating but had moved back to its original location. A second NOUO was left in June. In September, agents returned to the original location and determined that the station was no longer in operation on 90.9 MHz.

This month, the commission found that because Tulloch had “willfully and repeatedly” violated Section 301 of the Communications Act, it was proposing a base forfeiture of $10,000 for each of the violations in May and June. But the commission has discretion to boost forfeitures in certain cases, it added $5,000 for “the repeated and intentional nature of Mr. Tulloch’s apparent violations.”

The total proposed fine is $25,000. Tulloch has 30 days to pay or reach out to the commission with reasons why the fine should be reduced or cancelled.

Activity is on 40 to 10 meters, and possibly 6 meters, using CW,

RTTY and JT65. QSL via E21EIC.

INDONESIA, YB. Look for YB3MM/8 and YB3LZ/8 to be QRV from Tinabo

Island, IOTA OC-242, from April 28 to May 1. On May 1 and 2, they

will also be active from Salayar Island, IOTA OC-236. Activity will

be on 40 to 15 meters with two stations active. QSL via operators’

instructions.

Contest, NCCC RTTY Sprint, NCCC CW Sprint, SP DX RTTY Contest,

Helvetia Contest, Florida QSO Party, BARTG Sprint 75 and the AGCW

QRP/QRP Party are all on tap for this upcoming weekend.

The Phone Fray and CWops Mini-CWT Test are scheduled for May 2.

The ARRL International Grid Chase runs during all of 2018.

eHam.net News — From her love of Morse code to her passsion for Amateur radio, Ruth Willet ’21 has been able to learn more about the field of wireless communications from professionals around the country thanks to a scholarship she recently received. Willet, president of the newly revived Amateur Radio Club on campus, was awarded the Radio Club of America’s Young Achiever’s Award, which allowed her to attend the International Wireless Communications Expo (IWCE) in Orlando, Fla., March 5–9. “I was shocked to have received this award. I never dreamed I would be able to attend such a prestigious wireless event. It was an honor be recognized by the Radio Club of America and to be presented this award. It was an eye-opening experience for me to be exposed to the field of wireless communications and to be introduced to the discussions taking place among first responders and the government regarding emergency situation preparedness,” said Willet, who is double majoring in Mechanical Engineering and Engineering Physics at Kettering. “As an amateur radio operator, I’ve mostly only experienced the hobby side of radio. This conference allowed me to see a broad range of applications for radio and technology in a thriving industry that impacts both the workplace and our communities. It was very energizing to attend all sorts of workshops and seminars, and learn how much our daily lives are touched by the field of wireless communications.”
