No Time For California Concealed Carry Case: Strict Limits Here To Stay

We all know California has the reputation of being far more strict in terms of gun-control laws compared to other states. This reputation has been built through years of increased restrictions that are affecting our online ammunition store and other companies involved in the industry, as well as all you civilian gun owners. Recently, the Supreme Court has declined an appeal to California’s concealed gun policy.

Gun-rights supporters from the Los Angeles, San Diego, and San Francisco counties formulated an appeal to the strict laws restricting concealed carry in the state. They believed that they were being illegitimately deprived of permits to carry a concealed weapon outside of their home. However, the justices turned away this appeal with a 7–2 vote. They supported their reasoning by referencing the verdict from the 9th Circuit Court of Appeals which stated that the 2nd Amendment does not protect the right for a member of society to carry hidden firearms in public.

The overwhelming refusal to hear the appeal disturbed the two justices who were in favor of hearing it out. We will not mention specific names, but they came to the conclusion that the 2nd Amendment was becoming a detested right. This did not only disappointment the two justices but also the many gun-rights advocates here in America. Additionally, this recent action shows that although the right to bear arms is a Constitutional right, it may be rather limited in its’ scope.

In 2008 and 2010, similar rulings were implemented in Chicago and Washington, D.C. These rulings lessened the ability to possess a firearm, even if it was kept in one’s house for defense purposes. Since then, many appeals have been rejected.

California law states that law-abiding citizens can obtain a concealed weapon permit if they are able to provide “good cause”. However, the requirement for “good cause” has been set exceptionally high by county sheriffs.

This ongoing matter has many people watching the Peruta vs. California case. Originally a San Diego district judge supported the enforcement of the current concealed gun policy but in 2014 a 9th Circuit Panel claimed that the policy was unconstitutional. However, last year the same 9th Circuit Panel reconsidered their decision and retracted it citing historical documents and declared that carrying a concealed weapon without a license has never been allowed.

This situation has stirred up a lot of debate. Some argue that the denial to bear a firearm is in violation of their legal rights. However, some propose that this regulation encourages public safety and respects the 2nd Amendment by valuing the judgment of legal officials.
