Setbacks for New California Gun Measures

Applying new gun-control regulations in the state of California has not been the easiest process. There have been various holdups that have lead to unmet deadlines and confusion surrounding certain legislative matters. This confusion ultimately affects companies involved in the industry, like our ammo store in San Diego, because we are unsure of what to prepare for.

Recently, the expansion of the assault weapon definition has been one of the major changes in California gun control. This expansion prohibits magazines that hold 10 or more rounds of ammunition. Additionally, the magazine must be fixed, meaning it cannot be removed via a bullet button or other device. Although there are many other components to the expanded definition, we will not cover them all. The state of California has already been struggling to enforce these laws anyway. This is mainly due to the fact that there seems to be disagreements between offices. The Department of Justice originally drafted this expanded definition but the Office of Administrative Law believed that the DOJ was ignoring public comments about the subject matter. This dispute will delay the assault weapon registration by about six months.

This plan did not only seem to be a trivial problem but an unconstitutional shortening of the Second Amendment as well. Some people, including District Judge Roger Benitez, believed that the magazine requisition plan went against what the Second Amendment stood for.

The requirement to purchase ammunition through a legally licensed dealer is another element of the new California gun control laws. Those who wanted to apply for the license were supposed to be able to do so by the beginning of July. The Department of Justice was supposed to have an online database completely operational by the same date. However, neither option was available by the proposed deadline, which was disappointing for our ammo store in San Diego. It may be another few months until this process is fully functioning which is extremely discouraging. Depending on how proactive businesses are, certain dealers may be left without a license once 2018 comes around.

These issues have pushed numerous gun rights groups to take action. For instance, the California Rifle and Pistol Association along with the National Rifle Association have filed a lawsuit against the magazine plan, which led to Judge Benitez’ decision that was previously mentioned. Additionally, the Firearms Policy Coalition filed a lawsuit against the Department of Justice for denying the public access to their assault weapon plan.

By reading this, you may realize that the recent gun control measures have been extremely difficult to understand. This is the primary reason why they are so hard to enforce. Most attorney generals and lawyers can not figure out what is considered legal or not. Taking that into consideration, it may take some extra time until these gun control laws are understandable and feasible.
