Cows have been an essential aspect of rural lives as a source of livelihood. Therefore, killing a cow is against the law and is considered cruelty against animals. It is an offense that is cognizable under the Indian Penal Code.

Killing a Cow: Criminal Offence or Not?

  • Whoever sees someone killing a cow must report an FIR at the nearest police station as soon as possible. In this case, the punishment will either be a form of jail with a maximum sentence of five years, a fine, or both.
  • As stated in Section 11 of the Prevention of Cruelty to Animals Act of 1960, it is a crime to abandon any animal or leave it in a place where it may starve or thirst.
  • Not just killing a cow, but also killing other animals is illegal. According to Section 11(a) to (o) of The Prevention of Cruelty to Animals Act, 1960, the offender (for a first offense) should pay a fine that will reach fifty rupees if any creature is exposed to any type of viciousness specified treated in any pitiless manner.
  • If a second offense is reported within three years of the first offense, it must be reported. If this happens, the offender faces a fine of at least twenty-five rupees and a maximum of one hundred, up to six months in jail, or both. Similar to the first offense, the second carries a lifetime ban on animal ownership and the confiscation of the offender’s vehicle.
  • Sickening, poisoning, injuring, torturing, or killing any animal is a cognizable offense, as stated in Section 428 and Section 429 of the Indian Penal Code. Such a criminal offense carries a hefty sentence of a maximum of two years in prison, a heavy fine, or even both.
  • According to Section 425 of the Indian Penal Code, if a person carries out an act with the intent to cause or with the knowledge that the act is likely to bring damage leading to unjustified loss is punishable with imprisonment, which does not exceed three months, a fine or both.

How to Sue Someone for Killing a Cow

Gathering Proper Evidence- You must examine the reason for the death of your cow and present images of the damage on its body to prove that it died in order to effectively submit a complaint.

By Establishing Mischief- Under Section 425 of the Indian Penal Code, the prosecution must establish that there was intent to cause or with the knowledge that the act is likely to bring damage to someone leading to unjustified loss.

Filing an FIR- If your cow has been killed, you should notify the police. The police will investigate and write a report on the situation. You should also contact the authorities if you don’t know who killed or injured your cow. Unfortunately, before you can bring a case, you must be aware of who this person is. Every suit must identify a defendant. If you don’t know who injured your pet, perhaps the police can look into it.

Role of Lawyers

  • They prepare and evaluate numerous pieces of evidence and documents before the court if you face any criminal charges.
  • They interpret animal cruelty statutes and prior judicial rulings.
  • They keep them updated with animal cruelty laws.

Your best choice for finding a knowledgeable lawyer for your cattle may be a personal recommendation from somebody you know and trust.
