During my days as a law student, I always harbored the belief that law had a captivating facet beyond the traditional courtroom drama. It wasn’t until I stepped into the realm of technology post my call to the Nigerian Bar that I fully grasped the boundless potentials. I considered a career in technology so I delved into product management, an amazing career path to say the least but this article is not about that, let’s reserve that story for another time.

This article hopes to explain the nitty gritty of Tech Law and Legal Tech. It is important to understand that while the former is strictly a field for lawyers to play in, the latter is open to anyone with required tech skills. So, let’s get into it.

What is Technology Law?

You see, technology is so vast that it can cut across any field and professionals in various industries can find their place in it. Lawyers too have a role to play in the technology world. In this technology-driven era, corporations — both tech giants and businesses leveraging technology — rely on lawyers at every juncture. From pre-business incorporation to post-launch compliance, legal guidance is the bedrock.

Lawyers navigate the thin line between data collection and utilization, decipher regulations, and safeguard intellectual property — be it inventions, technology, or trade secrets.

Opportunities abound for lawyers in this domain. From law firms to private practice, legal consultation, or serving as in-house counsel, the options are as dynamic as the field itself.

Specific areas lawyers’ play important roles in tech

The legal field offers a wide array of roles within the technology sector beyond traditional legal practice. Here are some additional roles where lawyers with tech expertise can make a significant impact:

- Legal Counsel/Advisor for Tech Companies: Specialize in providing legal guidance to technology companies on issues ranging from intellectual property protection to data privacy and protection.

- Contracts and Agreements: This includes negotiating, drafting, and reviewing technology-related contracts such as software licensing agreements, technology transfer agreements, and service-level agreements.

- Regulatory Compliance: Oversee and ensure that tech products and services meet industry-specific regulations and standards, such as incorporation, cybersecurity regulations and telecommunications laws amongst others.

- Funding and Private Equity Advisory: Lawyers offer strategic counsel on securing investment and private equity funding to fuel tech companies’ growth.

- Data Protection and Privacy Compliance: With the rise of data privacy concerns, lawyers can take on roles to ensure that tech companies comply with data protection regulations and handle user data responsibly.

What then is Legal Technology?

This is a field I absolutely love. Technology’s fundamental goal is to simplify, refine, and streamline processes. This is exactly what Legal Tech is all about. Leveraging on technology to improve the legal industry, its practice and services.

In the words of Lord Denning MR, “If we don’t do what we haven’t been done before, the law will stand still while the world moves forward’.

Technology is reshaping every facet of life, and the legal sphere is no exception. Fortunately, people have begun to take the initiative to build technology enhanced products to solve certain challenges bedeviling the practice of law in Nigeria. Lawyers are now also taking a tech forward approach to solving legal problems.

While Legal Tech may not yet enjoy the limelight like its counterparts — FinTech, EdTech, HealthTech — it’s steadily gaining traction. In Nigeria, a wave of Legal Tech companies and products, such as Driotware, Lexlance, LFN App, Law Pavilion, DIY Law, and Lexify, are emerging to bridge the gap.
