Cooks at Sunset Station not to recognize the union as a representative

Recently, Culinary Local 226 members of the Station Casino facility decided to leave the union as an official representative.

Station casinos and unions have long been known as bitter rivals. In this sense, the unions have been aggressive in clearing station assets for years, and have campaigned several times to win.

However, neither has officially entered into a deal, and a 2021 court ruling ordered a fair negotiation with unionists at Red Rock resorts.

The same removal attempts were made at Palace and Boulder stations in 2020. In connection with those attempts, the company noted at the time that it would not recognize the union as a representative of that employee. The union also argued in a complaint to the National Labor Relations Board (NLRB) that the move by the station casino was illegal.

In a related statement dated April 22, union director Ted Papillorj argued that station casino managers were motivated to break up the union. He also noted that the company has a “shameful history of anti-worker behavior and defeat.” However, he believes the desertification of unions at Sunset Station is illegal.

Speaking on the matter, he noted in a statement: “The Culinary Association will file allegations of unfair labor practices in connection with the withdrawal and will continue to demand that the company negotiate in good faith on union contracts. Union destruction is disgusting and the Culinary Association urges Station Casino to do better.”

When asked for comment on the non-recognition process, the NLRB did not respond or comment saying it was aware of the current situation.

There are few processes of eliminating unions that require elections in which the president may not participate. Still, according to Bill Werner, a professor of Las Vegas at the University of Nevada, if an employer thinks they have evidence of a majority, they can remove the union certification. Werner, a research expert at Harah College of Hospitality, wrote, according to the Las Vegas Review-Journal, “When you have desertification like this, you can say you have multiple signatures. How did you get it? What did you tell them? Who circulated this petition? The union’s rationale is to challenge it. Of course, it puts them in the same position as before — the station is not negotiating with them. (It) is more legally a mess.”
