Boilerplate Online or Online Lawyer?


There are more than a few websites offering Terms & Conditions for websites and mobile applications. Most provide a basic document for free in exchange for an attribution, or a more custom document for a fee. These types of T&Cs are generated in your browser and if you go for the “custom” version you simply checkout with your credit card and receive your document by email or direct download.

So I was really interested when reading this article on Techvibes to see that the Author, Lawyer John Wires, was obviously interested in working with technology startups. His website has an online form for a Terms & Conditions quotation prepared by him — a Canadian Lawyer. The form was very easy to use — it asked a series of straightforward questions about our business and allowed me to upload our Articles of Incorporation. He followed up with a call the next day to get more details, explained his fee structure and that was it.

Needless to say I became a client. Having a Terms & Conditions for One Degree that is specific to the App, the country where we are headquartered, the country where the servers are located and many other specifics, cannot possibly be matched by any boilerplate T&C found online — even if you pay for it.

Did it cost money for our T&C? YES. It cost just about as much as the total amount to develop the app, get it into the store, have our website designed and hosted, incorporate our company and many other incidental costs over our first 7 months. Was it worth it? Absolutely. Not only do we have peace of mind that we have taken the very best steps to protect our company, but we found a really great Lawyer that understands startups — and that is immeasurable.
