Letter in defense of Ms. Mary Wagner
To: Honorable Justice Eric (Rick) N. Libman
Warsaw, August 23rd, 2017
Your Honor,
In the light of recent developments, I am writing this to express my support and gratitude for the efforts by Ms. Mary Wagner.
According to Ms. Wagner’s (as well as to my own) belief and best knowledge, her activity is aimed at saving human lives; her concern for saving another human being overrides the concern of potential violation of any lesser law.As in every lawsuit, the burden of proof lies on the plaintiff. Therefore, it is the plaintiff who should provide scientifically grouded evidence for the irrelevance of the term “human life” being used in relation to human embryos or fetuses as it is then and only then when Ms. Wagner’s actions could be classified otherwise.
With no scientific evidence of this sort being available, the court should not engage in matters extending beyond its competence lest its decision be guided by ideological rather than material premises.
On a separate note, since the suicide rates in women with post-abortion stress syndrome were demonstrated to exceed those in the overall female populations by a factor of 6 to as much as 225 (British Medical Journal 1996;313:1431, British Medical Journal 1997;314:902), Ms. Wagner’s efforts should also be considered prevention of maternal suicide.
I deeply believe that future generations — provided they choose to be more humane than ours — will recognize Ms. Wagner as a heroine for a most just and noble cause, and that her current judicial tribulations will be judged accordingly. The pending ruling is just history in the making.
Sincerely,
Marcin W. Markowicz, PhD
