First, I am a gun owner and a member of the NRA. All gun sales in a gun shops and over the Internet must have background checks. There are no “loopholes.” There is no way to enforce laws against gifted guns and guns that are straw purchased. My first firearm, a .22 cal semi-automatic rifle, was gifted to me for my 12th birthday 60 years ago. It hasn’t gotten up and killed anyone yet, but there is still hope (sarcasm). … but there is a law and a way that is Constitutional and enforceable for gifted and straw purchases. If someone sells or gifts a gun that is not done through an FFL and that gun is used in a crime, then the seller or gifter should be charged as an accessory to the crime. … problem solved.
