Whether browsing a website could be considered a “preexisting business relationship” is anyone’s guess, but my gut is that Criteo is in an extremely grey area of the law if they’re doing this to European users.

I can tell you that this would be illegal in Germany, for sure! Don’t think it is different in France. And from 2018 on the EU will have a unified data protection law which will make this behaviour illegal in any country of the EU.
