3rd Circuit Appeals Court UnLikely to Slam Delaware ‘Phony Emerald’ Law Firm
In 2016 after settling a lawsuit surrounding investors being bilked into putting their money into what had been determined to be phony treasure, the very same law firm made misrepresentations thereby denying Due Process in an employment civil rights case which could have garnered court sanctions. Why would multiple lawyers from the 2nd largest an enormous amount of fees taken from a small nonprofit serving at-risk teens and inner city Episcopal church to litigate against an unrepresented litigant, their former client? Thus far not being cited for bad faith litigation were these actions by Young Conaway Stargatt & Taylor, LLP attorneys:
First there was Scott Holt who was granted motions by both State and Federal court judges under 12 USC Section 1700 statutes irrelevant to the complaint;
Next there was Lauren Russell who her colleagues refer to her as ‘Killer’ who dodged a DQ motion having learned at a former client relationship existed and with over 200 Docket Items was awarded summary judgment by Chief Judge in charge of court entity on which Russell was appointed and serves;
Then next there is Molly DiBianco who verified the former client relationship at deposition and covered for Russell who took multiple maternity leaves during the course of this litigation; and
Finally there’s YCST partner Lisa Goodman who represents Trinity Church in legal matters and more than likely is the cause as to why no conflict of interest check was completed before taking on the case and how her law firm is positioned to win by uncapped fees from two insurers and should the nonprofit hosted by the church fail that all of its assets in the form of facility upgrades, equipment and furnishings, and thousands of dollars in reserve account funds more than likely will transfer to her home church where she and her partner were first in the State to have a civil union performed, Trinity.
Justice system mortals dabbling in ‘unGodly acts’ were in full effect in this case of represented versus unrepresented. Decided in Defendants favor on summary judgment which is deemed unconstitutional could likely proceed on 7th Amendment challenge at U.S. Supreme Court.
In a related matter of Delaware Superior Court Case No. N17C-05–101-JAP dismissal and reconsideration pending, it breaks down as follows:
Where an officer of the court, e.g., an attorney, however, actively participates in defrauding the court, then the court may entertain a Civ. R. 60(B)(5) motion for relief from judgment. See Toscano, supra.
By including at least one non-diverse, in-state or non-removing defendant, the Plaintiff creates a state court action that falls outside the limited jurisdiction of the federal courts and, thus, cannot be removed.
Scott Holt committed fraud upon the court 9/30/2014 by removing from Delaware Superior Court Plaintiff’s state claims complaint citing a false Federal question coupled with in-State Defendants and all of which led to Plaintiff’s discovery of harm by fraud 5/26/16 at Plaintiff’s deposition and return of Plaintiff’s client file showing a history of cover-ups and non-disclosures by YCST attorneys:
Teresa Fariss lied about EEOC investigation having had concluded, then concealed the fact that a Right to Sue letter had been issued April 1998;
Barry Willoughby did not report to the Federal District Court and Judge Sleet, YSCTs attorney client relationship with Plaintiff at anytime while Willoughby filed his multiple appearances December 2002 and February 2003 in Delaware District Court Case No. 1:02-cv-01648-GMS.
Lauren Russell, Scott Holt, and Margaret DiBianca did not report to the Federal District Court and Chief Judge Stark, YSCTs attorney client relationship with Plaintiff in Delaware District Court Case No. 1:14-cv-01248-LPS and Delaware District Court Case No. 1:14-cv-1021-LPS.
Over the course of 20 years, YCST has been enriched by what it is believed to be unlawful work of its attorneys while Plaintiff suffered financial losses in significant amounts.
