These assessments would be controversial as they relate to advertising and the GDPR, but more important, they do not take into account the proposed ePrivacy Regulation text, which requires consent for virtually all tracking activities, independent of whether a company has a separate Legitimate Interest or whether the data is Personal Data. The ePrivacy Reg looks to be a game changer.
