The main question is why not?

I could not disagree with you more. The Fourth Amendment is a guiding and sacred instruction that protects us from invasive acts by the government. It may be fashionable to cynically suggest that it is no longer in effect, but as an investigator I can tell you without any hesitation that it protects the people each and every day; it is respected by law enforcement and it means something. So cynics may say what they want, but I respectfully disagree with the tone and content of your comment.
