Actually, as of Saturday night, the FBI was still in talks with the Justice Department about obtaining a warrant that would allow agency officials to read any of the newly discovered Abedin emails, and therefore was still in the dark about whether they include any classified material that the bureau has not already seen.

There have been no reports that the FBI had inadvertently when looking for evidence related to the sexting crime, had read Abedin’s email while working at the State Department. Comey’s own letter says the FBI has no idea if the emails are even “significant.” If agents had read those emails, that would be in violation of the Fourth Amendment–which states that no search warrant can be issued unless it “particularly describes the place to be searched and the things to be seized.” It can be reasonably assume that the original warrant for Weiner’s laptop did not describe emails sent to or received by Abedin while working at the State Department.

There is smoke but no indication of fire–best to wait until investigations are completed.
